1. Acceptance of Terms

By accessing, registering for, or using the Viam-Bio service, platform, and website (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all the terms and conditions of this agreement, you may not access or use the Service.

2. Description of Service

Viam-Bio provides a platform that allows users to create a personalized landing page ("Link-in-Bio") to host multiple links, social profiles, and content in one place. We offer both free and paid subscription tiers ("Pro" and "Premium") that unlock additional customization, features, and analytics.

3. User Accounts and Security

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are solely responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Acceptable Use and Zero Tolerance Policy

You are solely responsible for the text, links, media, and other content ("Content") you display on your Viam-Bio page. We maintain a strict zero-tolerance policy for abuse. You agree NOT to use the Service to:

• Upload, link to, or promote content that incites violence, terrorism, self-harm, or illegal acts.
• Upload, link to, or promote sexually explicit material, pornography, or non-consensual intimate imagery.
• Harass, bully, defame, or promote discrimination/hate speech against any individual or group.
• Distribute spam, malware, phishing links, or engage in deceptive practices.
• Infringe upon the intellectual property rights of others.

Violation of these rules will result in the immediate and permanent termination of your account, without notice or refund.

5. Age-Restricted and Sensitive Content

If your Viam-Bio page links to content that is legally restricted to adults (18+) or contains highly sensitive material (e.g., adult themes that do not violate our pornography ban, or heavy profanity), you must enable the "Sensitive Content" toggle in your dashboard settings.

This setting places an age-related view confirmation prompt in front of your page, requiring visitors to confirm they are over 18 before proceeding. Failure to properly label 18+ links or sensitive content is a direct violation of these Terms and may lead to account suspension.

6. Intellectual Property Rights

Your Content: You retain all ownership rights to the Content you upload. By posting Content on Viam-Bio, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your Content solely for the purpose of operating the Service.

Our Content: The Service and its original content, features, functionality, and design are owned by Viam-Bio and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without prior written consent.

7. Paid Subscriptions and Billing

If you upgrade to a paid Pro or Premium plan, you agree to pay all applicable fees. Subscriptions are billed in advance on a recurring monthly or annual basis. You may cancel your subscription at any time through your dashboard; however, we do not provide refunds or credits for any partial subscription periods. Upon cancellation, you will retain access to paid features until the end of your current billing cycle.

8. Third-Party Links

Because Viam-Bio is a link-hosting platform, users will link to third-party websites. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Viam-Bio shall not be liable for any damage or loss caused by your use of or reliance on any such third-party content.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Viam-Bio makes no representations or warranties of any kind, express or implied, regarding the operation or availability of the Service, or the information, content, or materials included on it. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

In no event shall Viam-Bio, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

11. Indemnification

You agree to defend, indemnify, and hold harmless Viam-Bio and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
